Did you know? Calculating Redundancy Pay
The general rule under the NES provides that an employee’s service with an employer before 1 January 2010 counts as service of the employee with the employer for the purpose of determining the employee’s entitlements under the NES (other than entitlements to paid annual leave and paid personal/carer’s leave).
However, the general rule does not apply in relation to calculating an employee’s entitlement to redundancy pay if the terms and conditions of employment that applied to the employee’s employment immediately before 1 January 2010 did not provide for an entitlement to redundancy pay.
This should be kept in mind in relation to calculating an employee’s entitlement to redundancy pay under the NES.
